$745,000 For Fall in Supermarket
Plaintiff, fell at the Supremo Food Market in Plainfield on sept. 19, 2005, when she slipped on water leaking from a meat case.
She suffered torn Menisci in her knees, requiring Arthroscopic surgery, and underwent an endoscopic Discectomy on her back.
Her Attorney, Nicholas J. Leonardis of Stathis & Leonardis in Edison, says he sought video footage of the area for 2 hour before the fall to prove that the leaky condition existed for a long period of time and should have been corrected. However, the store conveniently provided only select portions of the video claiming the rest of the video had been taped over.
To protect his client, attorney Leonardis filed a motion and amended their complaint against Supremo to include a claim for Spoliation of Evidence. If the jury found that Supremo destroyed or Edited their video, Supremo may have be held liable for Punitive Damages. The case settled shortly after the court granted Attorney Leonardis' motion.
